§1 Scope of Application
These General Terms and Conditions apply to all services provided by DBT GmbH, in particular:
Deviating conditions of the customer shall only apply if they have been expressly acknowledged in writing by DBT GmbH.
- guided bicycle tours;
- guided city tours;
- private tours;
- group tours;
- school groups;
- corporate events;
- bicycle rentals;
- e-bike rentals;
- other tourism, cultural or educational services.
§2 Contracting Parties
The contracting party is generally the legal entity with whom the booking was made. Bookings may be made:
Where DBT GmbH acts solely as the performing service provider, the respective contractual relationships with the mediating contracting party remain unaffected. For on-site operations, the safety, conduct and liability regulations of DBT GmbH apply additionally.
- directly with DBT GmbH;
- through tour operators;
- through booking platforms;
- through travel agencies;
- through Baja Bikes;
- through TUI;
- through GetYourGuide;
- through Viator;
- through other distribution partners.
§3 Formation of Contract
The contract is formed upon booking and confirmation. Bookings may be made:
DBT GmbH reserves the right to decline or cancel bookings where there are objective reasons for doing so.
- online;
- by e-mail;
- by telephone;
- in writing;
- through third-party providers.
§4 Prices and Payment Terms
The prices published at the time of booking or individually agreed shall apply. All prices include statutory value added tax unless otherwise stated. Bank charges, credit card fees, exchange rate differences or other payment transaction costs shall be borne by the customer.
§5 Changes, Rebookings and Cancellations
Unless expressly agreed otherwise, bookings may be cancelled free of charge up to 48 hours before the start of the event. For cancellations within 48 hours before the start of the event, DBT GmbH may charge the full agreed price. Different cancellation terms may apply for groups, school classes, corporate clients or special events. These will be expressly stated in the respective offer.
§6 Force Majeure
DBT GmbH shall not be liable for service disruptions, delays, changes or cancellations due to force majeure. These include in particular:
DBT GmbH is entitled to adjust, postpone, shorten or cancel services.
- severe weather;
- storms;
- thunderstorms;
- flooding;
- pandemics;
- epidemics;
- official measures;
- demonstrations;
- security situations;
- traffic closures;
- strikes;
- terrorism warnings;
- other unforeseeable events.
§7 Participation Requirements
Each participant confirms by taking part:
Participation takes place at one's own risk.
- to be physically fit;
- to be mentally fit;
- to be able to ride a bicycle sufficiently;
- to have no health restrictions that would prevent safe participation;
- not to be under the influence of alcohol, drugs or other intoxicating substances.
§8 Personal Responsibility and Road Use
Each participant remains an independent road user at all times. Participation in a tour or bicycle tour does not exempt participants from the obligation to comply with all applicable traffic regulations. In particular, participants remain responsible for:
Instructions from tour guides must be followed. However, responsibility for one's own road use remains with the participant at all times.
- their speed;
- their safety distance;
- their braking behaviour;
- their attentiveness;
- their riding style;
- observance of the respective traffic situation.
§9 Foreign Participants
Participants are obliged to inform themselves about the traffic rules and legal regulations applicable in Germany prior to participation. Ignorance of local regulations does not give rise to any claims against DBT GmbH.
§10 Alcohol, Drugs and Intoxicating Substances
Participation under the influence of alcohol, drugs or other intoxicating substances is prohibited. DBT GmbH is entitled to exclude participants from the start or continuation of an event. There is no entitlement to a refund in such cases.
§11 Conduct of Participants
Participants must behave considerately and with safety awareness. In particular, the following are prohibited:
DBT GmbH is entitled to exclude participants for violations immediately and without any entitlement to a refund. DBT GmbH reserves the right to refuse future bookings.
- aggressive behaviour;
- threats;
- harassment;
- discrimination;
- racist statements;
- antisemitic statements;
- extremist statements;
- National Socialist symbols;
- disturbance of memorial sites;
- endangering other participants.
§12 Historical Sites and Memorials
At tours of historical sites, memorials and places of remembrance, all instructions from guides, security personnel, museum staff and authorities must be followed. Entering restricted areas is at one's own risk and is prohibited. DBT GmbH shall not be liable for damages arising from disregard of such instructions.
§13 Nature of Tours and Educational Offerings
The tours, lectures, workshops and educational offerings provided by DBT GmbH serve primarily to convey historical, cultural, social and political contexts.
The focus lies in particular on:
The services offered do not constitute a scientific publication, an academic seminar or a historical appraisal.
The content is researched, prepared and presented to the best of our knowledge and belief.
Nevertheless, in particular with regard to:
simplifications, abridgements, updates or unintentional deviations may occur.
There is no entitlement to scientific completeness, absolute accuracy or up-to-date information at all times.
The quality of a tour is not measured solely by the number of facts, figures or dates, but in particular by the comprehensible conveyance of historical contexts, backgrounds and developments.
Participants are expressly encouraged to explore the content further independently after the event.

§14 Bicycle Tours
Participation in bicycle tours takes place at one's own risk. Participants confirm that they:
DBT GmbH does not guarantee the complete avoidance of risks associated with cycling in public traffic areas. These include in particular:
- can ride a bicycle safely;
- can brake safely;
- can steer safely;
- are able to ride in urban traffic;
- understand the requirements of group riding.
- road traffic;
- tram tracks;
- road damage;
- construction sites;
- weather conditions;
- behaviour of other road users;
- suddenly appearing obstacles.
§15 City Tours and Walking Tours
Participation in city tours and walking tours takes place at one's own risk. Participants must pay particular attention to the following risks:
DBT GmbH shall not be liable for damages arising from lack of attention or disregard of local conditions.
- uneven pavements;
- cobblestones;
- stairs;
- kerbs;
- construction sites;
- weather conditions;
- slippery surfaces;
- crowds;
- historic structures.
§16 Bicycle Rental
DBT GmbH provides bicycles in a roadworthy and operational condition. A visual and functional inspection is carried out before handover. The renter is obliged to inspect the bicycle personally before commencing the journey. In particular, the following must be checked:
Recognisable defects must be reported immediately before commencing the journey. If no report is made, claims arising therefrom may be excluded or reduced to the extent permitted by law.
- brakes;
- tyres;
- lights;
- bell;
- saddle;
- handlebars;
- lock.
§17 E-Bikes
E-bikes are provided subject to availability only. Pre-reserved e-bikes take priority over spontaneous on-site requests. The user confirms that they are physically and technically able to operate an e-bike safely. The user acknowledges that:
The range of an e-bike depends, among other things, on:
No minimum range is guaranteed. In the event of a technical defect, DBT GmbH will endeavour to provide a replacement vehicle where possible. There is no entitlement to immediate replacement.
- e-bikes are heavier than standard bicycles;
- braking distances may be longer;
- handling and weight may differ.

- temperature;
- riding style;
- body weight;
- route profile;
- assistance level.
§18 Technical Defects
Despite regular maintenance, technical defects may occur. These include in particular:
DBT GmbH shall not be liable for damages based on unforeseeable defects or defects not recognisable despite proper maintenance, to the extent permitted by law.
- punctures;
- material fatigue;
- chain problems;
- brake problems;
- electronic faults;
- weather-related damage;
- concealed manufacturing defects.
§19 GPS Tracking Systems
Bicycles may be equipped with GPS, Bluetooth or comparable tracking systems. These systems serve in particular:
DBT GmbH provides no guarantee with regard to:
Technical faults, flat batteries, software errors, network failures or tampering may impair or prevent functionality. The existence of a tracking system does not release the user from their obligation to properly secure the bicycle.

- recovery;
- fleet management;
- incident investigation;
- protection of property.
- availability;
- accuracy;
- functionality;
- locatability;
- recoverability.
§20 Theft and Loss
The user is obliged to secure the bicycle properly at all times. If a bicycle is left unattended, the lock provided by DBT GmbH must be used. In the event of theft or loss, DBT GmbH must be notified immediately. Upon request, a police report must be filed. If no key can be produced or the whereabouts of the bicycle are unclear, the incident may be treated as a loss. The resulting costs may be charged to the user.
§21 Damage to Bicycles
The user is liable for damages caused by:
This applies in particular to:
DBT GmbH is entitled to claim repair, replacement or restoration costs.
- improper use;
- grossly negligent behaviour;
- intentional behaviour;
- disregard of instructions;
- violations of traffic regulations;
- loss of accessories.
- locks;
- keys;
- batteries;
- chargers;
- baskets;
- luggage racks;
- other accessories.
§22 Breakdowns and Mobility
Technical problems must be reported to DBT GmbH immediately. If agreed, a mobility or breakdown assistance service may be provided. If no mobility service has been agreed, the user remains obliged in principle to return the bicycle to the agreed return point at their own expense. Costs for separate collections may be charged in accordance with the current price list.
§23 Liability of Participants
Each participant is liable for damages caused by their own conduct. This applies in particular to damages:
Each participant remains an independent road user throughout the entire event. DBT GmbH accepts no liability for damages caused between participants, to the extent that no mandatory statutory liability of DBT GmbH exists.
- to other participants;
- to third parties;
- to vehicles;
- to bicycles;
- to buildings;
- to public facilities;
- to memorial sites;
- to rented equipment.
§24 Liability of DBT GmbH
The liability of DBT GmbH is governed by statutory provisions. DBT GmbH is liable without limitation for damages arising from injury to life, limb or health, to the extent that these are based on intentional or negligent conduct by DBT GmbH. For other damages, DBT GmbH is liable only in cases of:
In the case of slightly negligent breach of non-material contractual obligations, liability is excluded to the extent permitted by law. Liability under mandatory statutory provisions remains unaffected.

- culpable breach of material contractual obligations.
§25 Personal Belongings
Personal belongings are carried at the owner's own risk. DBT GmbH shall not be liable for loss, theft or damage to:

- mobile phones;
- cameras;
- computers;
- tablets;
- glasses;
- watches;
- jewellery;
- luggage;
- clothing;
- cash;
- identity documents.
- are attached to the bicycle;
- are transported in bicycle baskets;
- are left unattended during a tour.
§26 Mobile Phones, Cameras and Electronic Devices
The use of mobile phones, cameras, tablets, action cameras or comparable devices during participation is at the participant's own risk. Participants are obliged to comply with all applicable legal provisions. In particular, distractions caused by:

- filming;
- live streaming;
- telephone calls;
- social media;
- sending messages
§27 Duty to Cooperate
Participants are obliged to:
If required cooperation is culpably omitted, claims may be excluded in whole or in part to the extent permitted by law.
- avoid damages as far as possible;
- minimise damages as far as possible;
- report accidents immediately;
- report technical defects immediately;
- cooperate in the clarification of incidents.
§28 Complaints and Defect Notifications
Complaints must be reported immediately to the tour guide or to DBT GmbH. Damages, accidents, losses or thefts must be reported as soon as possible, but no later than within 72 hours of the incident. Complaints received later may be rejected if proper clarification is no longer possible due to the passage of time. Statutory warranty and liability claims remain unaffected.
§29 Photo and Video Recordings
Photo and video recordings may be taken during events. Where required by law, processing takes place exclusively on the basis of a valid consent or another permissible legal basis. DBT GmbH may use recordings for:
Participants may object to the use of their recordings before the start of an event, to the extent provided by law. Details are set out in the privacy policy.
- documentation;
- marketing;
- social media;
- press relations;
- corporate communications.
§30 Video Surveillance
Business premises, storage areas, bicycle stations or other operational areas may be subject to video surveillance. Video surveillance serves in particular:
Processing is carried out in accordance with the GDPR and applicable data protection laws. Regular recordings are stored only for the period required in each case. In the event of an incident, relevant recordings may be stored until the matter is concluded.

- theft prevention;
- the investigation of criminal offences;
- the preservation of evidence.
§31 Data Protection
Personal data is processed exclusively within the framework of applicable data protection laws, in particular the General Data Protection Regulation (GDPR). Personal data may be processed for the purposes of:
Bicycles may be equipped with tracking systems. The processing of corresponding data takes place exclusively for the purposes stated in these GTC and the privacy policy. Further information is contained in the current privacy policy of DBT GmbH.

- booking processing;
- customer communications;
- payment processing;

- fraud prevention;
- safeguarding legitimate interests;
- fulfilment of legal obligations.
§32 School Groups and Minors
For school groups, youth groups or comparable events, the duty of supervision and care remains at all times with the accompanying teachers, legal guardians or other supervisory persons. The guides of DBT GmbH do not assume any educational, pedagogical or statutory duty of supervision. Accompanying persons remain responsible for:
Minors may only participate if the consent of their legal guardians or the responsible institution has been obtained.
- the conduct of participants;
- compliance with safety instructions;
- health-related matters;
- disciplinary measures;
- supervision of minors.
§33 Corporate Clients and Group Bookings
For corporate events, association events, group trips or other group bookings, the organiser is deemed to be the responsible contact person. The organiser confirms that they are authorised to make the booking on behalf of the participants. The organiser undertakes to inform all participants about these GTC as well as all safety and conduct regulations. DBT GmbH is entitled to rely on the fact that all participants have been duly informed.
§34 Intellectual Property
All intellectual property rights in the content, concepts and materials developed or used by DBT GmbH remain exclusively with DBT GmbH or the respective rights holders.
This applies in particular to:
The copyright protectability of individual content is not required for the protection afforded by this provision.
Protected in particular are also the individual selection, structuring, preparation, combination and presentation of content.
The narrative approaches, communication methods, tour dramaturgies, training methods and didactic concepts developed by DBT GmbH constitute independent intellectual achievements.
Use, reproduction, recording, publication, distribution, adaptation, translation or commercial exploitation is not permitted without the prior written consent of DBT GmbH.
In particular, the following are prohibited:
The recording, transcription, analysis or processing of tours, workshops, lectures or training sessions by means of artificial intelligence, language models, transcription software or comparable technologies requires the prior written consent of DBT GmbH.
Statutory permissible uses remain unaffected.
Further civil or criminal claims are expressly reserved.

- tour routes;
- narrative structures;
- didactic concepts;
- presentation methods;
- training programmes;
- training materials;
- workshops;
- presentations;
- texts;
- graphics;
- photographs;
- videos;
- audio recordings;
- trademarks;
- logos;
- company names;
- websites;
- digital content;
- databases;
- research work;
- historical compilations;
- scripts;
- event formats;
- teaching and training materials.
- copying tours or training content in whole or in part;
- using tour concepts for one's own or competing offerings;
- passing on training materials;
- recording events;
- adopting content for one's own tours or training sessions;
- processing materials in an automated manner or feeding them into databases.
§35 Goodwill Services
Refunds, discounts, vouchers, rebookings or other voluntary services are provided exclusively as a gesture of goodwill. Goodwill services do not constitute:
- an admission of fault;
- an acknowledgement of liability;
- an entitlement to future services.
§36 Exclusion of Participants
DBT GmbH and its guides, employees, agents and representatives are entitled to exclude participants from an event if:
In the event of an exclusion, there is generally no entitlement to a refund.
- safety risks exist;
- instructions are repeatedly disregarded;
- other participants are endangered;
- alcohol or drug influence is present;
- discriminatory behaviour occurs;
- extremist statements are made;
- the proper conduct of the event is significantly disrupted.
§37 Statements by Employees
Verbal statements, assurances, assessments or offers made by:
do not constitute an acknowledgement of liability or a contractual amendment. Binding statements require written confirmation by the management or a duly authorised person.

§38 Independence of Group Companies
DBT GmbH may form part of a corporate group. Each company acts as a legally independent entity on its own account. Contractual relationships exist exclusively with the company that actually offers or performs the relevant service. Liability of other group companies is excluded to the extent permitted by law.
§39 Insurance Obligation and Personal Provision
Each participant is personally responsible for maintaining adequate insurance cover. This includes in particular:
DBT GmbH expressly recommends taking out appropriate insurance. Participants acknowledge that they are generally responsible for bearing the financial consequences of damages, losses or failures themselves, to the extent that no statutory liability of DBT GmbH exists.
- health insurance;
- accident insurance;
- liability insurance;
- travel insurance.
§40 Severability Clause
Should individual provisions of these GTC be or become wholly or partially invalid, unenforceable or void, the validity of the remaining provisions shall not be affected. In place of the invalid provision, the legally permissible rule that most closely approximates the economic purpose of the invalid provision shall apply.
§41 Applicable Law and Jurisdiction
The law of the Federal Republic of Germany applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory consumer protection provisions of their respective country of residence additionally apply, to the extent that these are applicable. To the extent permitted by law, the place of jurisdiction for all disputes arising from or in connection with this contractual relationship is Berlin.
§42 Final Provisions
These General Terms and Conditions together with:
